
Your investment must create at least 10 full-time jobs for qualifying U.S. workers, generally within about two years of your admission as a conditional permanent resident.
Job creation is at the heart of EB-5. The new commercial enterprise must create at least 10 full-time positions for qualifying U.S. employees. These jobs must be for U.S. workers and meet the program's definition of full-time employment.
The way jobs are counted differs between direct investments and investments made through a USCIS-approved regional center. Regional center cases may count certain indirect and induced jobs created as a result of the investment, while direct cases generally count actual employees of the enterprise. Demonstrating that the required jobs were created is a central part of removing conditions later in the process.
