Before the family member travels, the sponsor applies for a temporary authorisation to stay (response within a maximum of 9 months); after arrival the family member declares their arrival at the commune within 3 days, has a medical exam, and applies for the residence permit within 3 months.
Family reunification is a two-stage process. First, while the family member is still abroad, the sponsor submits an application for a temporary authorisation to stay to the General Department of Immigration, with proof of resources, accommodation, health insurance and the family relationship. The authorities may take up to nine months to decide. If a visa is required, the family member then applies for a Type D visa.
Once in Luxembourg, the family member must declare their arrival at the local commune within three days, undergo a medical examination including TB screening, and lodge the residence permit application within three months. The first permit is usually valid for one year and is renewable as long as the conditions are still met. A common mistake is missing the three-day declaration or the three-month permit deadline, which can jeopardise the whole application.
