
You first get the temporary subclass 309, then become eligible for the permanent subclass 100 two years after you first applied, provided your relationship continues.
The offshore partner visa is a single application that covers two visas. First you may be granted the temporary Partner (Provisional) visa (subclass 309), which lets you live, work and study in Australia while the permanent stage is processed.
You become eligible for consideration of the permanent Partner (Migrant) visa (subclass 100) two years after you first lodged the application. At that point the Department reassesses you, you provide additional documents, and in most cases you must continue to be in a genuine and ongoing relationship with your sponsor. To get the subclass 100 you must hold the subclass 309 (or a Dependent Child visa subclass 445) at the time.
