If your claim is found eligible, it is referred to the Immigration and Refugee Board of Canada (IRB), which decides whether you meet the refugee definition.
When you make an asylum claim inside Canada, IRCC or the CBSA first decides whether your claim is eligible to be referred. If it is eligible, the claim goes to the Immigration and Refugee Board of Canada (IRB), an independent tribunal.
The IRB's Refugee Protection Division (RPD) then holds a hearing and decides whether you meet the definition of a Convention refugee or a person in need of protection. The IRB, not the officer who took your claim, makes that protection decision.
