The H-1B specialty-occupation category has an annual numerical cap. Employers first submit an electronic registration for each candidate during a set window. If registrations exceed the cap, USCIS conducts a random selection (the 'lottery'). Only selected registrations are eligible to file a full H-1B petition (Form I-129). Cap-exempt employers, such as universities and certain non-profits, can file outside the lottery.
