The most frequent error is applying based on outdated guidance. Since January 21, 2025, only spouses of students in qualifying graduate or select programs, and spouses of workers in management, professional, or priority-sector jobs, are eligible. Applying when the principal applicant does not meet these conditions usually leads to a refusal.
Another common issue is timing for spouses of workers: the worker must have enough authorization remaining (at least 16 months) when you apply. Submitting too late, or without proof of the relationship and the principal applicant's eligibility, can cause delays or refusals.
