
The ICT permit, under the EU ICT Directive, lets companies transfer managers, specialists and trainee employees from a non-EU branch to a Luxembourg entity of the same group, with possible mobility to other EU states.
The Intra-Corporate Transferee permit comes from the EU ICT Directive and is designed for transfers within the same company or group. It applies to three categories of staff: managers, specialists and graduate trainees being moved from a branch outside the EU to a Luxembourg entity of the group. To qualify you generally need prior employment with the group for a minimum qualifying period, an assignment for a managerial, specialist or trainee role at the Luxembourg host entity, qualifications appropriate to the position, and a compliant employment relationship.
The application is filed by the host entity ahead of the transfer, so it is largely employer-driven. The permit also carries the possibility of mobility to other EU states within the group, which suits multinational assignments.
A EUR 80 residence permit fee applies and a decision on the authorisation to stay normally comes within about three months.
