Exceptional ability means a degree of expertise significantly above the norm in the sciences, arts or business, shown by meeting at least three of the regulatory criteria.
The exceptional ability path is for people whose expertise is significantly above what is ordinarily encountered, in the sciences, arts or business. You do not necessarily need an advanced degree, but you must document at least three of six criteria.
Those criteria include an official academic record showing a relevant degree or diploma, at least ten years of full-time experience in your occupation, a professional license or certification, evidence of a high salary reflecting exceptional ability, membership in professional associations, and recognition for achievements and contributions by peers, governmental entities or professional organizations. As with EB-1, meeting the criteria is the threshold, and USCIS still assesses whether the overall record demonstrates exceptional ability.
