You must be outside Australia when you apply for the subclass 309, and any family who apply with you must also be outside Australia. You can be in or outside Australia when it is decided.
The subclass 309 is the offshore (temporary) stage of the partner visa, so location matters. You must be outside Australia at the time you lodge the application, and any family members included in your application must also be offshore when you apply.
When the Department actually decides your temporary visa, you can be either in or outside Australia. This is the key practical difference from the onshore subclass 820 pathway, which requires you to be in Australia at the time of application.
