EB-4 generally relies on Form I-360 rather than the Form I-140 used by other employment-based categories. Whether the applicant or a sponsor files depends on the specific subcategory.
For special immigrant religious workers, for example, either a U.S. employer or the worker may file the I-360. Some other EB-4 groups have their own petitioners or processes defined by the relevant law. Confirming who is the proper petitioner for your specific subcategory is important, because filing under the wrong basis can lead to denial.
