
Standard EB-2 needs a DOL labor certification (PERM, ETA-9089) then Form I-140; NIW skips PERM and files I-140 directly. After approval you file I-485 or process a visa abroad when a number is available.
For employer-sponsored EB-2, the process begins with PERM labor certification through the Department of Labor using Form ETA-9089. Once certified, the employer files Form I-140 with the job offer. For a National Interest Waiver, you skip PERM and file the I-140 directly, including the employee portions of the labor certification form for reference only.
After the I-140 is approved, you complete permanent residence either by adjustment of status (Form I-485) in the US or consular processing abroad, but only when your priority date is current under the Visa Bulletin. EB-2 backlogs vary significantly by country of chargeability, so the priority date you secure when the case is filed can heavily influence your overall wait.
